A show cause notice is a formal document that is issued when Council believes an unlawful use is occurring on your property. It sets out the details of an alleged offence and asks the recipient to explain why disciplinary action should not be taken, therefore “showing cause”. The show cause notice outlines different ways of responding, whether it be to remove the unlawful use, or to submit an application to keep it there, along with providing a timeframe for these choices. If you fail to respond to the show cause notice, it could cause penalties including fines, or a further enforcement notice to be issued to you.
